Abstract
This paper outlines some history and issues surrounding the development of the railway codes of practice in Australia, in the context of the changes that the industry is going through. The paper presents industry comments, legal opinion and concerns expressed over time in relation to the impact of these codes, and it questions the assertion that the codes drafted are given to support the view that the current codes contain serious flaws that may put the industry at risk. The paper whilst presenting a warning, recommends that those in the industry should assist in the process of forming a common view as to the function and purpose of the codes and then to contribute to the process of having the codes written in such a way as they assist and protect those in the industry, to the benefit of industry.
